PREAMBLE

These general conditions of sale "Terms and Conditions of Use" are concluded between Muslim Queens and any non-commercial natural person ("The User") wishing to make a purchase on the Website www.muslim-queens.com

The Parties agree that these General Conditions exclusively govern their relationship. The www.muslim-queens.com site reserves the right to modify the General Conditions from time to time. They are applicable as soon as they are put online.

If a condition of sale were to fail, it would be considered to be governed by the customs in force in the distance selling sector whose companies are headquartered in Belgium.

ARTICLE 1: OBJECT

The General Conditions aim to define the terms and conditions between the www.muslim-queens.com site and the User, from placing the order to after-sales services, including payment and delivery.

ARTICLE 2: PRODUCTS

The products governed by these General Conditions are those which appear on the Website www.muslim-queens.com and which are indicated as sold and shipped by Muslim Queens. They are offered within the limits of available stocks.

The products are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred in this presentation, the responsibility of Muslim Queens cannot be engaged.

The photographs of the products are not contractual.

ARTICLE 3: PRICES

The prices of the products are indicated in euros all taxes included. They take into account the VAT and any reductions applicable on the day of the order. Product prices do not include delivery costs (postage, packaging and packaging of the package according to the amounts in force). The amount of the delivery costs will be specified on the order form before the validation of the order.

If one or more taxes or contributions, in particular environmental, were to be created or modified, up or down, this change may be reflected in the sale price of the products on the website and on the various sales media.

However, a price cannot be changed once the User's order has been confirmed.

 

ARTICLE 4: ORDER

4.1. Prior identification of the User

To place an order, the User must identify himself with his email address and password. For any first order, the User must follow an account creation procedure indicated on the website www.muslim-queens.com

If the password is lost or forgotten, the User can request it again by going to their customer account and clicking on "I forgot my password". They will then receive their password on the email address they provided when they registered.

4.2. Registration and validation of the order

Once the basket is validated, the User must accept the General Conditions, choose the address and delivery method, and finally validate the payment method, this last step formalizing the sales contract between Muslim Queens and the user.

Any order implies acceptance of the prices and descriptions of the products available for sale.

Once your purchase has been confirmed, no cancellation or modification can be made to your order.

No order modification is possible, this includes (color change, deletion of one or more articles, addition of one or more articles)

No modification to the recipient's address is possible, this includes (name / surname, address, city, postal code, telephone number)

Muslim Queens will acknowledge receipt of the order upon validation by sending an email.

In some cases, including default of payment, wrong address or other problem with the user's account, Muslim Queens reserves the right to block the User's order until the problem is resolved. If the product ordered is unavailable, the User will be informed by email.

The cancellation of the order of this product and its possible refund (only the Products available at the time of the order may be subject to a direct debit, as opposed to deferred products) will then be made, the rest of the order remaining firm and final.

ARTICLE 5: PAYMENT TERMS

The User has the choice to pay for his purchases:

By bank card: Carte Bleue, e-carte bleue, Visa, Matercard, American Express Card.

With their PAYPAL account: by choosing PAYPAL payment, the User will be automatically directed to their PAYPAL account. Once the payment has been validated, the User can complete their order on the site.

Muslim Queens does not keep any record and has no access to the banking data of its customers.

ARTICLE 6: DELIVERY

6.1. Delivery method

The products will be delivered to the address indicated by the User on the order form. All products leave our premises in perfect condition; thus the customer must report to the carrier the slightest trace of shock (holes, traces of crushing ...) on the package, and if necessary to refuse the package. A new product will then be returned to them at no additional cost.

The exchange of any product declared, a posteriori damaged during transport, without any reservation having been made upon receipt of the package, can not be supported by Muslim Queens.

Packages are prepared from Monday to Friday, and the preparation of the order is done within 24 to 48 hours upon receipt of payment.

As in all shipments, it is possible to be delayed or the product to get lost. In such a case, we contact the carrier to start an investigation. All efforts are made, as long as necessary, to find this package. In case of proven loss declared by the carrier, the merchant will be reimbursed by the carrier and will deliver a new identical package at his expense. We decline all or part of our responsibility if we can provide evidence that the non-performance or poor performance of the delivery contract is attributable either to the consumer, or to the fact, unpredictable and insurmountable, of a third party to the contract, or to a force majeure. We are also not responsible for the additional delivery times charged by our partners, in particular during the SALE and end-of-year celebrations, and in the event of late delivery, the customer cannot claim the request for reimbursement of the costs of Harbor.

6.2. Delivery error

The consumer will have to formulate with Muslim Queens within 7 clear days, any claim of error of delivery and / or non-conformity of the products in kind or in quality compared to the indications appearing on the purchase order. The formulation of this complaint with Muslim Queens can be made by post or email. Any claim not made in the rules defined above and within the time limits could not be taken into account and will release Muslim Queens from any responsibility vis-à-vis the User.

In the event of a delivery or exchange error, any product to be exchanged must be returned to Muslim Queens as a whole and in good condition.

Return case: if your package is returned to us for wrong address, nonexistent address, non-recovery of the package at the relay point or at the post office, or any other reason you must pay the re-delivery costs. In case of cancellation of your order, the refund will not take into account the shipping costs remaining at your expense.

ARTICLE 7: RIGHT OF WITHDRAWAL

The right of exchange only applies to natural persons.

The customer has a period of 14 calendar days to exchange products that do not suit him. This period runs from the day of receipt of the consumer's order. All exchanges must be reported in advance to Muslim Queens Customer Service.

Any item on promotion is neither returned nor exchanged.

Any product that has been damaged after receipt of it will not be refunded, returned or exchanged.

Items must be returned in their original packaging with label.

Items must not have been worn.

Any return that does not meet the conditions will be refused.

ARTICLE 8: RESPONSIBILITY

Muslim Queens has for all stages of order taking as well as for the stages subsequent to the conclusion of the contract an obligation of result.

Thus Muslim Queens undertakes to describe with the greatest accuracy the products sold on its site. However, it cannot be held liable in the event that the non-performance of its obligations is attributable either to the unforeseeable and insurmountable fact of a third party to the contract or to a case of force majeure as defined by Belgian case law. Likewise, Muslim Queens cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, an outside intrusion or the presence of computer viruses.

ARTICLE 9: INTELLECTUAL PROPERTY

All elements of the www.muslim-queens.com website, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. Likewise, the brands, logos, designs and models appearing on the site are the exclusive property of Muslim Queens. Their disclosure cannot in any case be interpreted as granting any license or right to use any of the said trademarks and distinctive elements protected by copyright. They cannot therefore be used under penalty of counterfeiting.

Thus, none of the documents from the site can be copied, reproduced, published, downloaded, posted, transmitted or distributed in any way.

However, it is possible to download a copy of the documents to a computer for the personal use of the user and only for non-commercial purposes, provided that the User does not modify the information contained and that he keeps intact all copyrights and other proprietary notices. The modification of these documents or the use for another purpose constitutes an infringement of intellectual property rights.

ARTICLE 10: NON PARTIAL VALIDATION

If one or more stipulations of these general conditions are held for not validated or declared as such in application of a law, a regulation or following a final decision of a competent jurisprudence, the other stipulations will keep all their force and their scope.

ARTICLE 11: NON WAIVER

The fact for one of the parties not to claim a breach by the other party to any of the obligations referred to within the framework of these General Conditions of Sale cannot be interpreted for the future as a claim to the obligation in question.

ARTICLE 12: PROTECTION OF PERSONAL DATA

All the data that the User entrusts to Muslim Queens, is in order to be able to process his orders.

Under Belgian law relating to data processing, files and freedoms, the User has the right to rectify, consult, modify and delete the data communicated.

ARTICLE 13: APPLICABLE LAW AND JURISDICTIONAL JURISDICTION

Any order placed through www.muslim-queens.com implies the client's adhesion, without any restriction, to the General Conditions of Sale of Muslim Queens. In the event of a dispute, the User can seize the District Court or High Court with territorial jurisdiction of his choice in accordance with the article of the Code of Civil Procedure. This article provides in principle that the plaintiff who brings a legal action can seize either the court where the defendant lives, or the court where the goods will have been delivered.

In the event of sale to a legal person, any differences relating to the sale (price, GTC, products, etc.) will be subject to Belgian law before the Commercial Court at the headquarters of Muslim Queens.
